Abstract
The overruled are those groups of people who find themselves outside of the community of democratic lawmaking, while still being exposed to the sovereign power of those laws. Using the theoretical framework of Giorgio Agamben this study argues that foremost among the overruled are refugees and asylum-seekers who find themselves as “bare life,” living in a state of exception without the rights of citizens. Extraterritorialization is found to be central to both asylum law and the immigration policy decisions taken by the EU.
